Procurement law and state aid law

Procurement law

As a contracting authority, you regularly come into contact with procurement law. Procurement law consists of a set of European and Dutch rules and a multitude of court rulings. It is a complex area of law that develops rapidly and is characterized by short periods of time in which swift action is required.

Jan van den Heuvel and Margo van Nisselroij specialize in this area of law. They have extensive experience, both in the field of advising and litigating and are both members of the Dutch Association for Procurement Law (NVvA). Both have completed the specialist postgraduate course in European and Dutch procurement law at Grotius Academy, which provides specialized postgraduate courses for experienced lawyers. Meester Job Ebish recently joined this practice group.

State aid law

They also have extensive experience in advising in the field of state aid law. European state aid law prohibits governments from giving businesses an unjustified advantage that is not in line with market conditions, but can also, within the framework of the regulations, offer governments opportunities to support businesses. State aid can take many forms such as grants, guarantees, suretyships, and land transactions which can give companies an advantage that is not in line with the market conditions. The problem of state aid can also play a role in area development and project development. Recognizing state aid and obtaining advice on time is of great importance to you as a government authority.

We gladly advise you on these matters and also about the possibilities of providing support within the framework of the legislation and regulations to make it ‘state-aid proof’.

For questions, please contact Jan van den Heuvel or Margo van Nisselroij.
